In accordance with laws and regulations and departmental management responsibilities, the Ministry of Education, the Ministry of Foreign Affairs, and the Ministry of Public Security jointly formulated the "Administrative Measures for the Enrollment and Training of International Students in Schools." It is hereby announced and will come into force on July 1, 2017.

Administrative measures for recruiting and training international students
第一章 总 则
Chapter I General Provisions
Article 1 These Measures are formulated by the education law of the people's Republic of China, the Exit and Entry Administration Law of the people's Republic of China, and other laws and regulations to standardize the recruitment, cultivation, and management of international students by schools, providing convenience for international students to study in schools within the territory of China, promoting foreign exchange and cooperation in education, and improving the internationalization level of China's education.
Article 2 the term "schools" as mentioned in these Measures refers to the schools that implement pre-school education, primary education, secondary education, and higher education within the territory of the people's Republic of China.
International students mentioned in these Measures refer to foreign students who do not have Chinese nationality and receive education in schools according to the nationality law of the people's Republic of China.
Chapters II to V of these measures apply to institutions of higher learning. For schools implementing pre-school, primary, and secondary education, their enrollment, teaching and internal management of international students shall be carried out in accordance with the provisions of provinces, autonomous regions, and municipalities directly under the central government.
Article 3 in recruiting and training international students, schools shall abide by Chinese laws, regulations, and state policies, safeguard state sovereignty, security, and public interests, and standardize management and ensure quality.
International students should abide by Chinese laws and regulations, respect Chinese customs, abide by school rules and regulations, and complete school learning tasks.
Article 4 The administrative department of education under the State Council shall be responsible for the overall management of the work of international students nationwide, formulating macro policies for recruiting and training international students, guiding and coordinating the educational administrative departments and schools of the people's governments of provinces, autonomous regions, and municipalities directly under the central government to carry out the work of international students, and may entrust relevant units and industrial organizations to undertake the management and service of international students.
The foreign affairs, public security, and other administrative departments of the State Council should do a good job in the management of international students according to the division of responsibilities.
Article 5 the administrative departments of education of the people's governments of provinces, autonomous regions, and municipalities directly under the central government shall guide, coordinate and supervise the work of international students in their respective administrative areas, and shall be responsible for studying and formulating relevant policies on the work of international students in pre-school, primary and secondary education in their respective administrative areas.
The foreign affairs, public security, and other administrative departments of the people's governments of provinces, autonomous regions, and municipalities directly under the central government should do a good job in the management of international students according to the division of responsibilities.
Article 6 schools that recruit international students shall establish and improve the system of recruiting, training, managing, and serving international students and be specifically responsible for recruiting and training international students.
Chapter II enrollment management
Article 7 institutions of higher learning that recruit international students shall have the corresponding educational and teaching conditions and training abilities, and independently recruit international students in accordance with the relevant provisions of the state.
Article 8 institutions of higher learning that recruit international students shall put on record in accordance with the matters and procedures prescribed by the administrative department of education under the State Council.
Article 9 for international students recruited by institutions of higher learning, the categories of academic education they receive are junior college students, undergraduates, postgraduates, and doctoral students; the categories of non-academic education they receive are preparatory students, advanced students, and research scholars.
Article 10 institutions of higher learning independently determine the enrollment plans and majors for international students in accordance with their school running conditions and training abilities, unless otherwise stipulated by the state.
Article 11 institutions of higher learning shall, in accordance with the provisions of the state on enrollment, formulate and promulgate the general rules for enrollment of international students of their own universities, and recruit international students in accordance with the conditions and procedures specified in the general rules for enrollment.
Article 12 institutions of higher learning shall examine the admission qualifications and financial guarantee certificates of foreign citizens who have applied for registration, and examine or assess them. The admission of international students shall be decided by the University; those who do not meet the requirements for admission shall not be admitted by the University.
Article 13 institutions of higher learning may, with the consent of the original enrollment institutions, accept international students admitted or transferred to other institutions.
Article 14 The items and standards of fees charged by institutions of higher learning for international students shall be implemented in accordance with the relevant provisions of the state.
Institutions of higher learning shall publish the items and standards of fees charged for international students, as well as the regulations on the refund of fees for dropping out and transferring students. The charges and refunds shall be priced in RMB.
Chapter III teaching management
Article 15 institutions of higher learning shall incorporate the teaching plan for international students into their overall teaching plan, select teachers suitable for international students' teaching, and establish and improve the quality assurance system of education and teaching.
Article 16 international students shall, in accordance with the curriculum arrangements and teaching plans of institutions of higher learning, take part in the course study, and shall, in accordance with the regulations, take the corresponding graduation examination or assessment. Schools shall record their academic achievements and daily performance truthfully.
Chinese and the general situation of China should be compulsory courses for higher education; political theory should be compulsory courses for international students majoring in philosophy and political science.
Article 17 after admission, international students may change their majors with the application of the students and the consent of the institutions of higher learning. The conditions and procedures for changing majors shall be stipulated by the school.
Article 18 the common spoken and written language of the people's Republic of China is the basic teaching language for colleges and universities to train international students. For international students whose national common language level can not meet the learning requirements, the school can provide necessary remedial conditions .
Article 19 qualified institutions of higher learning may offer specialized courses in foreign languages for international students. For international students receiving higher education in a foreign language, their dissertations may be written in the corresponding foreign language, and their abstracts shall be in Chinese; whether their dissertations are answered in a foreign language shall be determined by the University.
Article 20 institutions of higher learning shall, in accordance with their teaching plans, organize international students to take part in teaching practice and social practice, and shall abide by the relevant provisions of the state in choosing places for practice and practice.
Article 21 institutions of higher learning shall issue academic certificates or other academic certificates to international students in accordance with the relevant provisions of the state. For international students receiving higher degree education, institutions of higher learning shall timely handle the electronic registration of student status and graduation certificate.
Institutions of higher learning award degree certificates to international students who meet the requirements of degree-awarding.
Chapter IV school management
Article 22 institutions of higher learning shall clearly define the institutions responsible for the management of international students, and shall be responsible for the overall coordination of the recruitment, teaching, daily management, and services of international students, as well as alumni contacts after graduation.
Article 23 institutions of higher learning shall make public to international students the basic information of the University, education and teaching conditions, enrollment brochures, and international student management and service system, to facilitate international students to obtain information.
Article 24 institutions of higher learning shall provide accommodation and other necessary living service facilities for international students, establish, improve and publish the management system for the use of service facilities. International students who live outside the dormitories shall register with the Public Security Department of their residence in time.
Article 25 institutions of higher learning shall educate international students in such aspects as Chinese laws and regulations, school discipline and rules, national conditions and school conditions, excellent traditional Chinese culture and customs, to help them get familiar with and adapt to the learning and living environment as soon as possible.
Colleges and universities should set up international student counselors to understand the needs of international students in their study and life and provide timely information, consultation, sports, and other services. The proportion of international student counselors is not lower than that of Chinese student counselors, and they enjoy the same treatment as Chinese student counselors.
Article 26 institutions of higher learning shall encourage international students to participate in recreational and sports activities beneficial to their physical and mental health, and provide convenient conditions for them to participate in such activities. International students can voluntarily participate in public welfare activities and celebrations of major Chinese festivals.
Colleges and universities generally do not organize international students to participate in military training and political activities.
Article 27 with the consent of institutions of higher learning, international students may hold activities to celebrate their own important traditional festivals in the designated places and areas within the institutions of higher learning, but they shall not have any words or deeds against or against other countries or nationalities or against public morality.
Article 28 with the approval of institutions of higher learning, international students may set up social organizations within the institutions of higher learning to carry out activities within the scope prescribed by Chinese laws and regulations and accept the guidance and management of the institutions of higher learning.
Article 29 institutions of higher learning shall respect the national customs and religious beliefs of international students, but shall not provide places for religious activities. No religious activities such as missionary work or religious gatherings are allowed in the school.
Article 30 while studying in Institutions of higher learning, international students may participate in work-study activities, but they may not engage in employment, business, or other business activities.
The specific regulations on the administration of international students' work-study programs shall be formulated separately by the administrative department of education under the State Council in conjunction with relevant departments.
Article 31 Institutions of higher learning shall carry out the management of international students' status with reference to the Chinese regulations on the management of students' status. If a school decides to drop out or expel an international student, it shall put it on record in accordance with the provisions of the education administrative department of the State Council.
Chapter V scholarship
Article 32 the Chinese government shall set up Chinese government scholarships for international students receiving higher education and encourage local people's governments to set up international student scholarships.
Measures for the administration of Chinese government scholarships shall be formulated by the relevant administrative departments of the State Council.
Article 33 The administrative department of education under the State Council shall, on a selective basis, entrust institutions of higher learning to train scholarship students of the Chinese government. Institutions of higher learning undertaking the task of training Chinese government scholarship students shall give priority to recruiting Chinese government scholarship students.
Article 34 institutions of higher learning may set up scholarships for international students. Enterprises and institutions, social organizations, and other social organizations and individuals are encouraged to set up international student scholarships, but unreasonable conditions shall not be attached.
Chapter VI social management
Article 35 foreigners who apply to study in the schools referred to in Article 2 of these Measures shall, before entering China, apply to the Chinese embassy or consulate in the country of their nationality or residence or other foreign institutions entrusted by the Ministry of foreign affairs for the visa of X1 or x2 according to the period of their study, and submit relevant materials such as the certificate filed by the competent department of education and the admission notice issued by the school.
Article 36 If an international student holds a study visa indicating that he needs to apply for a residence certificate after entering the country, he shall, within 30 days from the date of entering the country, apply to the exit Entry Administration Department of the public security organ in the place where he intends to reside for a study alien's residence certificate.
Article 37 If the Ministry of foreign affairs has other provisions on the application of personnel of foreign diplomatic missions, consulates, and representative offices of international organizations in China and their accompanying family members to study in schools, the provisions of the Ministry of Foreign Affairs shall apply. Those who fail to go through the relevant procedures according to the regulations shall not be recruited by the school.
Article 38 When a school enrolls an international student under the age of 18 whose parents are not resident in China, it shall require his parents to formally entrust a foreigner or Chinese resident in China as the guardian of the international student and provide relevant supporting materials.
The school can accept international students who study in groups for a short time, but it should sign an agreement with the foreign sending unit in advance. If a school with primary or secondary education accepts international students for short-term study in the form of a group, the foreign sending unit shall, in accordance with the laws and regulations of the country where the school is located, go through the relevant legal procedures for organizing the entry and exit of minors in advance, and shall send someone to accompany the group and act as the guardian of the international students during their study in the school.
Article 39 when international students enter school, they shall go to the Chinese health and quarantine department in accordance with the provisions of the Chinese administrative department of health to go through the confirmation procedures of the physical examination records of foreigners or have a physical examination. Those who are confirmed by a physical examination to have serious mental disorders, infectious pulmonary tuberculosis, or other infectious diseases that may cause great harm to public health as stipulated in the law of the people's Republic of China on the administration of exit and entry shall be dealt with by the public security department according to law.
Article 40 the school shall implement the system of full insurance for international students. International students must be insured in accordance with relevant national regulations and school requirements. Those who fail to purchase insurance in accordance with the regulations, they should apply for insurance within a time limit. If they fail to apply for insurance within the time limit, the school will not accept them. Those who have studied in the school, should drop out or not register.
Chapter VII Supervision and Administration
Article 41 The administrative department of education under the State Council shall establish and improve the system of supervision over the quality of international student training. The educational administrative departments of provinces, autonomous regions, and municipalities directly under the central government shall supervise the training of international students in their respective administrative regions.
Article 42 The administrative departments of the State Council, such as education, public security, and foreign affairs, which are responsible for the management of international students, shall use modern information technology to establish an international student information management system, promote the mechanism of information sharing and constantly improve the management and service of international students.
Article 43 international students who violate the laws and regulations of the people's Republic of China on the administration of exit and entry, the law of the people's Republic of China on the administration of public security and punishment, and the regulations of the people's Republic of China on the administration of foreign nationals' entry and exit and the provisions on the administration of religious activities of foreigners within the territory of the people's Republic of China shall be dealt with in accordance with the law.
Article 44 If an institution of higher learning commits the following acts in the process of recruiting and training international students, the competent administrative department for education shall order it to rectify the act, investigate legal responsibility in accordance with the relevant provisions of the education law of the people's Republic of China, and may restrict its recruitment of International students:
(1) Violating the state regulations and the regulations on enrollment of the school;
(2) There are profit-making behaviors in the process of enrollment;
(3) Failing to make public the items, standards, and fees according to the items and standards;
(4) Issuing degree certificate, academic degree certificate or other academic certificates in violation of the regulations;
(5) The teaching quality is poor or the management and service are not in place, which causes bad social impact;
(6) Other illegal acts.
第八章 附 则
Chapter VIII supplementary provisions
Article 45 short term learning in these Measures refers to the period of study in Chinese schools not exceeding 180 days (including), and long-term learning means that the study time in Chinese schools exceeds 180 days.
Article 46 If a scientific research institution within China that has been approved to undertake the task of postgraduate education recruits international students, the measures shall be implemented.
The measures shall be followed in case of the admission of international students by educational institutions that implement non-education with non-academic backgrounds approved by the administrative department of education.
The enrollment, training, and management of students in the Hong Kong Special Administrative Region, Macao Special Administrative Region, and Taiwan, as well as the enrollment, training, and management of schools for children of foreign nationals in China shall be in accordance with other relevant provisions of the state.
Article 47 the departments of education, foreign affairs, public security and other departments of the people's governments of provinces, autonomous regions, and municipalities directly under the central government shall, in accordance with these measures, formulate the administrative provisions of their own provinces, autonomous regions and municipalities directly under the central government.
第四十八条 本办法自2017年7月1日起施行。 教育部、外交部、公安部2000年1月31日发布的《高等学校接受外国留学生管理规定》、教育部1999年7月21日发布的《中小学接受外国学生管理暂行办法》同时废止。
Article 48 These Measures shall come into effect as of July 1st, 2017.
